These Terms of Service govern access to and use of products, services, websites, and applications provided by Clear Water Concepts. By accessing or using Services, you agree to be bound by these Terms. If you do not agree, discontinue use immediately.

By using Services, you confirm you are at least eighteen (18) years of age and have legal authority to enter into these Terms. If using on behalf of an entity, you represent authority to bind that entity.

Clear Water Concepts provides professional water treatment services, including water softening, reverse osmosis systems, water filtration installations, and maintenance services. Specific scope and details will be outlined in separate documentation.

3. Quotes, Pricing, and Payment

3.1 Quotes

Any quotes provided are valid for thirty (30) days unless otherwise stated. Pricing may change after this period.

3.2 Pricing

All prices are in U.S. Dollars and subject to applicable taxes, fees, and surcharges.

3.3 Payment Terms

Payment terms will be agreed upon in writing before work commencement. Payment may be required upfront, upon completion, or via installment schedule. Late payments may be subject to fees or interest.

4. Customer Responsibilities

4.1 Access and Cooperation

Provide Clear Water Concepts reasonable access to property for inspection, installation, maintenance, or service.

4.2 Accuracy of Information

All information provided must be accurate, current, and complete. Promptly notify of changes to contact information or other details affecting service delivery.

5. Product and Service Warranties

5.1 Manufacturer Warranties

Products carrying manufacturer's warranties will be passed through to fullest extent permitted. Claims follow manufacturer procedures.

5.2 Service Warranty

Installation and repair services will be performed in workmanlike manner consistent with industry standards. Contact regarding workmanship issues for review.

5.3 Disclaimer of Other Warranties

EXCEPT AS EXPRESSLY PROVIDED HEREIN, CLEAR WATER CONCEPTS DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CLEAR WATER CONCEPTS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES RESULTING FROM THE USE OF, OR THE INABILITY TO USE, THE SERVICES OR PRODUCTS, EVEN IF CLEAR WATER CONCEPTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Clear Water Concepts' total liability shall not exceed the total amount paid for the specific service or product in the twelve (12) month period preceding the liability event.

7. Indemnification

You agree to defend, indemnify, and hold harmless Clear Water Concepts and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your use of Services, violation of Terms, or violation of third-party rights.

8. Intellectual Property

All intellectual property rights in Services, including website, logos, trademarks, and content, are owned or licensed by Clear Water Concepts. You may not reproduce, distribute, modify, or create derivative works without express written consent.

9. Compliance with Laws

Agree to comply with all applicable laws, regulations, and ordinances, including local building codes, plumbing regulations, and water quality standards for water treatment system installation or maintenance.

10. Text Messaging

Text messaging opt-in data are not shared with third parties. By providing your phone number, you consent to receive informational and marketing messages from Clear Water Concepts, including autodialer messages. Consent is not a purchase condition. Message and data rates may apply. Reply STOP to unsubscribe.

11. Termination

Clear Water Concepts reserves the right to terminate or suspend access at any time for any reason, including Terms violations. Upon termination, all granted rights cease immediately.

12. Governing Law and Dispute Resolution

These Terms are governed by Arizona law without regard to conflict of law principles. Any dispute shall be resolved exclusively in state or federal courts in Maricopa County, Arizona. You consent to such jurisdiction and waive venue objections.

13. Changes to Terms

Clear Water Concepts reserves the right to modify Terms at its sole discretion. Material changes will be posted on the website or through other reasonable means. Continued use indicates acceptance of changes.

14. Severability

If any provision is found unlawful, void, or unenforceable, it shall be severable and not affect remaining provisions' validity and enforceability.

15. Entire Agreement

These Terms, along with written agreements or documentation at point of sale or service, constitute the entire agreement and supersede all prior understandings, whether written or oral.
